By participating in any activity sponsored or organized by Mind Wellness Performance (“MWP”), you affirm that you have read the below provisions and understand its contents.

You understand that hiking, running, racing, cycling, swimming, social activities, and other activities in which MWP and its members participate, or that are sponsored or organized by MWP and/or by representatives or members of MWP, including any of the Released Parties listed below (collectively, “MWP Activities”), are activities with an inherent element of danger and risk. You agree not to enter and participate in any MWP Activity unless you are medically able and properly trained. You voluntarily assume sole responsibility for all risks associated with participating in MWP Activities, including, but not limited to, falls, contact with other participants, spectators or others, the effect of the weather, including heat and/or humidity, and traffic, all such risks being known and appreciated by you.

In consideration of MWP’s allowance of you to participate in any MWP Activity: a) you, for yourself and for anyone entitled to act on your behalf, waive, release, and discharge MWP and its owners, members, affiliates, sponsors, officers, website administrators and moderators, representatives, coaches, employees, agents, licensors, suppliers, contributors to any blog contained on the MWP Website (“MWP Blog”), and contributors to the MWP Website Bulletin Board (“Bulletin Board”) (collectively, the “Released Parties”), from all claims or liabilities of any kind, known or unknown, arising out of your participation in or traveling to and from any MWP Activity; b) you agree not to sue any of the Released Parties for any of the claims or liabilities that you have waived; and c) you indemnify and hold harmless the Released Parties from any claims made or liabilities assessed against them as a result of your actions during any MWP Activity even though that liability may arise out of negligence or carelessness on the part of the persons named in this waiver.

You grant permission to the Released Parties to use or authorize others to use any photographs, motion pictures, recordings, or any other record of your participation in any MWP Activity for any legitimate purpose without remuneration.

When you take part in hikes or other organized athletic events you will abide by the rules set forth by the organizers of those events. You understand that violation of this requirement is grounds for sanction by MWP, up to and including your permanent dismissal from the group. You agree to abide by any decision of any official connected to any such event relative to your ability to safely complete the event.

By participating in any MWP Activity this form you agree to all of the above terms and conditions.
